You are solely responsible for maintaining the security of your account credentials and for all activity on your account. Accounts may not be transferred, sold, assigned, or licensed to any other person.

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they appear on your screen due to the type of device you use and your device settings.

Products fulfilled via Printify are made-to-order print-on-demand (POD) items, while products fulfilled via Zendrop are dropshipped from U.S. warehouses. Please note that due to variations in display screens and the custom nature of POD products, we cannot guarantee that the appearance, color, or quality of the product will exactly match what you see on your screen. SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase products from Planckwave Designs. We reserve the right to accept or decline your order at our sole discretion for any reason, including but not limited to product availability, pricing errors, or suspected fraud. Your order is not confirmed until you receive a confirmation email from us and payment has been processed.

Please review your order carefully before submitting. Once an order is confirmed and payment is processed, cancellations or modifications may not be possible. If you wish to cancel or modify your order, contact us immediately, and we will attempt to accommodate your request, but we cannot guarantee changes.

If we do not accept, modify, or cancel an order, we will attempt to notify you using the email, billing address, and/or phone number provided at the time the order was made.

All purchases are subject to our Refund Policy. You represent and warrant that your purchases are for personal or household use only and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time your order is placed, as reflected in your order confirmation email. Unless explicitly stated, posted prices do not include taxes, shipping, handling, customs, or import charges. You agree to update your account and other information promptly, including your email address, credit card numbers, and expiration dates, to enable us to complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are authorized to use the payment method provided, (iii) charges incurred by you will be honored by your payment provider, and (iv) you will pay all charges, including shipping, handling, and applicable taxes, at the posted prices.

SECTION 5 – SHIPPING AND DELIVERY

We strive to fulfill and ship your orders promptly, but we are not responsible for shipping delays caused by third-party carriers, weather conditions, or any other events beyond our control. All estimated delivery times are estimates only; specific delivery dates cannot be guaranteed. Once products are transferred to the carrier, title and risk of loss pass to you. Tracking information will be provided when available.

Returns, Replacements, and Refunds
Custom-made Print-on-Demand (POD) products are non-returnable and non-refundable unless defective or damaged. Defects or damages must be reported within 7 days of delivery with photographic evidence. Verified defective POD products will be replaced, or if unavailable, refunded in accordance with the fulfillment provider’s policies.

For non-POD items fulfilled via dropship (Zendrop), returns are not accepted. Refunds or replacements are issued only if the vendor is at fault (report 7–30 days, provide photo/video evidence).

Shipping delays or issues outside of our control, including third-party carriers or fulfillment providers, are not grounds for refunds.

SECTION 6 – INTELLECTUAL PROPERTY

All content and materials on our Services — including but not limited to designs, logos, product names, text, images, graphics, video, audio, reviews, and the arrangement and selection thereof — are owned or properly licensed by Planckwave Designs and protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You must not reproduce, distribute, publicly display, modify, create derivative works of, republish, download, store, or transmit any materials without our prior written consent. Nothing herein grants you rights to Planckwave Designs’ intellectual property or that of third parties. Unauthorized use may violate copyright, trademark, and other laws.

Certain content, such as YouTube videos (e.g., Miss Monique) or RSS feed items, may be displayed through third-party services. These are included for content curation purposes, and all copyrights and other rights remain with the respective owners.

All POD product designs sold on the Services are owned by Planckwave Designs, except for items purchased with a commercial license (e.g., via Masterbundles) or displayed through third-party apps (e.g., Collective).

Planckwave Designs’ names, logos, product names, and slogans are protected as intellectual property. Use of these or any similar marks without our prior written consent is prohibited. All rights not expressly granted are reserved.

Third-Party Content Disclaimer: Content provided through embedded services, such as YouTube videos, RSS feeds, or other third-party sources, belongs to the respective content owners. Planckwave Designs does not claim ownership of any third-party content. Any use of such content on our site is for display, educational, or entertainment purposes only and is subject to the terms and policies of the respective content providers.

All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS

As part of the Services, you may have access to tools, features, or content provided by third parties (“Optional Tools”), including content feeds or integrations. Planckwave Designs does not control or endorse these Optional Tools and provides access “as is” and “as available,” without warranties or liability. Your use of Optional Tools is at your own risk. Any complaints, claims, or questions regarding third-party products or services should be directed to the third-party provider.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Planckwave Designs is powered by Shopify, which provides the platform to operate our Store and deliver the Services. All sales and purchases are made directly with Planckwave Designs. By using the Services, you acknowledge and agree that Shopify is not responsible for any part of your transactions, including product quality, delivery, or any injury, damage, or loss arising from purchases. You expressly release Shopify and its affiliates from any claims, liabilities, or damages related to your purchases or interactions with Planckwave Designs.

SECTION 10 – PRIVACY POLICY

Your privacy is important. Personal information collected through the Services is governed by our Privacy Policy. By using the Services, you confirm you have read and understood it.

We may, at our discretion, monitor, edit, or remove Feedback that is unlawful, offensive, defamatory, pornographic, obscene, or otherwise objectionable, or that infringes any intellectual property or violates these Terms.

You are solely responsible for any Feedback you submit, including its accuracy, and must not submit content that violates any third-party rights or contains malware.

Feedback or reviews posted on third-party platforms (e.g., Trustpilot, Judge.me) are also subject to those platforms’ own terms and moderation policies.

By providing feedback, you grant Planckwave Designs a non-exclusive, royalty-free, worldwide license to use, display, and distribute your feedback in connection with our Services.

While we strive for accuracy, the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. Planckwave Designs reserves the right to correct such errors, update information, or cancel orders if any information is inaccurate, even after an order has been submitted, without prior notice. Additionally, you agree not to: (a) upload viruses, malware, or other harmful code; (b) reproduce, duplicate, copy, sell, or exploit any portion of the Services; (c) collect or track personal information of others without consent; (d) spam, phish, scrape, or otherwise circumvent intended functionality; or (e) interfere with the security of the Services, related websites, or the Internet. Planckwave Designs may suspend, disable, or terminate your account at its discretion for violations of these Terms.

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Planckwave Designs, Shopify, or users of the Services, or expose them to liability.

Planckwave Designs may terminate this agreement or your access to the Services (or any part thereof) at any time, in its sole discretion, without prior notice. You remain responsible for any amounts owed up to the date of termination.

The following provisions survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other terms that by their nature are intended to survive.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. To the maximum extent permitted by law, Planckwave Designs, its affiliates, officers, employees, agents, contractors, and Shopify are not responsible for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or damage to property that may arise from your use of the site, products, or services, even if we have been advised of the possibility of such damages. Our liability shall not exceed the total amount you paid for the product(s) in question.

You agree to indemnify, defend, and hold harmless Planckwave Designs, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, arising from (1) your breach of these Terms or related documents, (2) your violation of any law or third-party rights, or (3) your use of the Services.

We will notify you of any indemnifiable claim, though failure to promptly notify does not relieve you unless materially prejudiced. We may control defense and settlement of such claims, including choice of counsel, but will not settle any claim imposing non-monetary obligations on you without your consent. You agree to cooperate in defending indemnified claims.

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

These Terms, together with any policies or rules posted by us on the Services, constitute the entire agreement between you and Planckwave Designs, superseding all prior or contemporaneous agreements, communications, and proposals, whether written or oral.
Any ambiguities in these Terms shall not be construed against the drafting party.

You may not delegate, transfer, or assign this Agreement, or any of your rights or obligations under these Terms, without our prior written consent; any such attempt will be null and void.
Planckwave Designs may assign, transfer, or delegate these Terms, and its rights and obligations hereunder, without your consent or prior notice.

SECTION 21 – GOVERNING LAW

These Terms of Service and any separate agreements under which we provide Services shall be governed by and construed in accordance with the laws of the United States and the state where Planckwave Designs is headquartered. You and Planckwave Designs consent to the exclusive venue and personal jurisdiction of the federal and state courts located in that state.
